HM Tech Solution (“we”, “us”, “our”, “Company”) operates the website https://hmtechsolution.com/carbooking/ (the “Website” or “Platform”), an online service facilitating car bookings and rentals in Pakistan.

These Terms and Conditions (“Terms”) govern your access to and use of the Website, making bookings, and using our services. By accessing, browsing, or booking through the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

• You must be at least 21 years old (or the minimum age required by the vehicle owner/rental partner) and legally capable of entering contracts.
• For self-drive rentals: You must hold a valid Pakistani driving license (or International Driving Permit if applicable) for at least one year, and provide CNIC/NICOP/Passport.
• We reserve the right to refuse service or cancel bookings if eligibility requirements are not met.

2. Bookings and Reservations

• All bookings are made through the Website and are subject to availability and confirmation by the vehicle owner or rental partner.
• A booking confirmation (via email/SMS/WhatsApp) does not guarantee the vehicle until full payment or deposit is received and verified.
• Bookings are binding once confirmed. You agree to provide accurate information (name, contact, CNIC, license, etc.).
• We act as an intermediary/platform; the actual rental contract is between you (the Renter) and the vehicle owner/partner. We are not a party to the rental agreement unless explicitly stated.

3. Payments

• Prices displayed include base rental charges, taxes (if applicable), and platform fees. Additional charges (fuel, driver fee, tolls, cleaning, damages) may apply.
• Payments are processed via secure third-party gateways. We do not store full card details.
• A security deposit (cash or hold on card) may be required at pickup, refundable subject to vehicle condition.
• Full payment or partial advance is required to confirm booking. Late payments may result in cancellation.
• Currency: All charges in Pakistani Rupees (PKR).

4. Cancellation and Refund Policy

• Cancellations by Renter:
  
  • More than 48 hours before pickup: Full refund minus platform fee (if any).
  • 24–48 hours before: 50% refund.
  • Less than 24 hours or no-show: No refund.
• Cancellations by us/partner (e.g., vehicle unavailable, force majeure): Full refund.
• Refunds processed within 7–14 business days to original payment method.
• Special promotions/offers may have stricter cancellation rules.

5. Use of Vehicle

• Vehicle must be used only for lawful purposes, in accordance with Pakistan traffic laws.
• Prohibited: Sub-renting, off-road use, racing, overloading, driving under influence, or any illegal activity.
• Only authorized drivers (listed at booking) may drive. Additional drivers may incur extra fees.
• Mileage limits (if applicable) and fuel policy (e.g., full-to-full) will be specified in booking confirmation.
• Renter is responsible for traffic violations, fines, tolls, and parking charges during rental.

6. Insurance and Liability

• Basic insurance may be included (third-party liability as per law). Comprehensive coverage depends on the partner/vehicle.
• Renter is liable for damages, loss, theft (if due to negligence), or excess wear & tear beyond normal use.
• Security deposit covers minor damages/claims. Excess damages billed to Renter.
• We/our partners are not liable for indirect losses (e.g., missed flights, business interruption) except as required by law.

7. Vehicle Condition and Return

• Vehicle inspected at pickup; Renter must report issues immediately (photos recommended).
• Return vehicle in same condition, clean, with full fuel (per policy), at agreed time/location.
• Late return: Charged hourly/daily rate + possible penalty.
• Early return: No refund for unused time unless agreed.

8. Prohibited Conduct

• Misuse of Platform (fraudulent bookings, fake details).
• Posting false reviews or harassing staff/partners.
• We may suspend/terminate access for violations.

9. Limitation of Liability

• Platform provided “as is”. We disclaim warranties for uninterrupted service or error-free operation.
• Maximum liability limited to booking amount paid (where permitted by law).
• Not liable for partner/owner actions, vehicle defects (beyond reasonable checks), or third-party claims.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the vehicle, breach of these Terms, or violation of laws.

11. Governing Law and Dispute Resolution

• These Terms governed by laws of the Islamic Republic of Pakistan.
• Disputes subject to exclusive jurisdiction of courts in Karachi, Sindh.
• We encourage informal resolution first—contact us before legal action.

12. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Check “Last updated” date.
